Social Media Discretion is Important During the Bankruptcy Process

In today’s digital age, social media has become a pervasive part of our lives, giving us the ability to share everything from personal milestones to daily activities with people around the world. However, when going through a bankruptcy, maintaining discretion on social media is not just advisable but crucial. Missteps in this area can have significant implications for your case.

The wrong post on Facebook, Instagram, Twitter, TikTok or another social media platform could put your debt relief efforts in jeopardy. During bankruptcy proceedings, the court and trustee scrutinize your financial situation to determine your eligibility for relief. Should you qualify, your debts might be discharged or you could receive a suitable repayment plan. Social media posts about new purchases, lavish vacations or financial windfalls can raise red flags. Such content might suggest that you have the means to pay off debts or manage financial obligations, potentially leading to complications in your case or even accusations of fraud.

Someone seeking bankruptcy protection must file a complete, accurate description of their financial situation. Mentioning a job or another income source online might raise a red flag if the pay you received is not reflected on your disclosure. Depending on your privacy settings, creditors could be capable of learning about you and might use that information to claim you are not being forthright with the court.

Before filing for bankruptcy, review your social media profiles for any posts that could be problematic. If necessary, clean up your accounts to remove content that might be viewed unfavorably by the court or creditors. Use direct, private methods to communicate sensitive information. Any situations that require you to discuss your financial situation with friends or family should be done through in-person conversations or private messaging, rather than public posts.

Bankruptcy and divorce often go hand in hand. Though it can be tempting to try to get your side of the story out there, or to show your ex how well you’re doing without them, social media discretion is very important for participants in both bankruptcy and matrimonial proceedings. By being mindful of what you share online and seeking guidance from your attorney, you can prevent avoidable mistakes and give yourself the best chance for a favorable resolution.
